Upon the consumer's approval of the contract related to the order, the specified amount for the ordered Products on this page will be collected from the consumer using the chosen payment method. The SELLER holds no responsibility for disputes between the consumer and the bank, and is not liable for any material, legal, financial, or non-financial consequences.
4- DELIVERY EXPENSES AND EXECUTION
The ordered Products will be delivered to the Consumer, a third party, or institution at the address provided by the Consumer within the legal 30-day period. Products in stock will be delivered to the address and person specified by the CONSUMER during the order within a maximum of five (5) days from the order date through the MNG Cargo, with which we have an agreement. Cargo companies, depending on their distances, usually deliver to the BUYER within an average of 3 (three) business days after receiving the shipments from the SELLER. If the MNG cargo company does not have a branch where the Consumer is located, the Consumer must pick up the delivery from another nearby branch notified by the SELLER (Notification will be made by email, SMS, or phone). Unless explicitly stated otherwise and unless otherwise stated, in domestic sales, the shipping cost and similar delivery expenses are borne by the Seller. In foreign sales, the shipping cost and similar delivery expenses are borne by the Buyer. If the Consumer is not present at the address during delivery and the persons at the address do not accept the delivery, the SELLER is deemed to have fulfilled its performance in this regard. If there is no one to receive the product at the address, it is the responsibility of the Consumer to contact the cargo company to follow up and arrange for the shipment of the products. If the product is to be delivered to a person or organization other than the Consumer, the SELLER cannot be held responsible if that person or organization is not at the address or refuses the delivery. Every person receiving the product must check it at the time of delivery and, if there is a problem with the product due to shipping, reject the product and record it with the cargo company official. Otherwise, the SELLER will not accept any responsibility.
The delivery of the Product within the legal maximum period of 30 days to the Consumer is considered to be on time. If, due to extraordinary circumstances (such as adverse weather conditions, earthquake, flood, fire), the Product cannot be delivered within the legal maximum 30-day period, the SELLER informs the Consumer by contacting them using the contact information. In this case, the Consumer can cancel the order, order a similar product, or wait until the extraordinary situation ends.
If the SELLER realizes that it cannot supply the Product covered by the contract, with the explicit consent of the Consumer within three (3) days from the date of learning this situation, it can supply another product/service of equal quality and price and fulfill the commitment under this Contract in this way. The Consumer is free to give or not to give approval in such cases, and in cases where approval is not given, the contractual and legal provisions regarding the termination of the contract are applied.
4 – RIGHT OF WITHDRAWAL
The Consumer has the right to withdraw from the contract without giving any reason within fourteen (14) days from the date they receive the Product. However, for certain contracts related to specific goods/services, even if they are unused/unconsumed, there is no statutory right of withdrawal. Please note that for certain goods, such as swimwear, underwear products, etc., where hygiene adhesive stickers, special packaging, tape, etc., protective elements have been opened, and the return is not suitable for health and hygiene, there is no right of withdrawal. Here is the complete list of goods and services for which the statutory right of withdrawal cannot be used:
Goods and Services Ineligible for the Right of Withdrawal Under Legal Regulations:
a) Goods specifically prepared according to the consumer's special requests or personal needs (including custom products modified or personalized based on the consumer's order, whether sourced domestically or internationally).
b) Perishable goods such as cosmetics, chocolates, and other food items with a limited shelf life.
c) Goods like cosmetics, swimwear, and intimate apparel where protective elements such as packaging, seals, and tape have been opened after delivery, rendering them unsuitable for return due to health and hygiene concerns.
d) Goods that have mixed with other products after delivery and cannot be separated due to their inherent nature.
e) Unsealed books, CDs, DVDs, audio and video recordings, software, and other digital content, as well as computer consumables.
f) Services performed instantly in the electronic environment and non-material goods delivered instantly to the consumer, as well as any other goods or services falling outside the scope of distance selling as accepted by the consumer for commercial or professional purposes.
g) Goods or services with prices subject to fluctuations in financial markets beyond the control of the seller or provider.
h) Services related to specific dates or periods, such as accommodation, transportation of goods, car rentals, catering, entertainment, or leisure services.
i) Services initiated with the consumer's consent during the withdrawal period.
j) Other goods or services generally accepted by relevant regulations as outside the scope of distance selling, including cases where the consumer makes purchases for commercial or professional purposes.
In cases where the right of withdrawal is legally applicable, the consumer is responsible for any changes or damages resulting from non-compliance with usage instructions during the withdrawal period. Consequently, the consumer may lose the right of withdrawal for the product. Additionally, if accepted voluntarily, the seller has the right to apply a discount from the product price equal to the change or damage.
In the event of withdrawal, the relevant product must be returned within a maximum of ten (10) days. Clear notification of withdrawal can be made to the contact addresses specified above and by phone. Upon exercising this right, the consumer must provide a cargo delivery receipt sample indicating the return of the product to us, along with the original invoice/delivery note. For product returns with invoices issued on behalf of institutions, a return invoice must be issued. Additionally, the returned products, along with their boxes, packaging, and any standard accessories, must be submitted to us complete, undamaged, and in good condition.
In cases where the right of withdrawal is not legally envisaged, it cannot be exercised. If this right is not used correctly or in a timely manner, the consumer loses the right of withdrawal. In accordance with the conditions mentioned above, and provided that it is done in a timely and correct manner by the consumer, within 14 days from the date the withdrawal notification reaches our Company, the product price and any delivery expenses of the product, using the payment method used by the consumer when purchasing the product, will be refunded. However, if the right of withdrawal is used for the entire order or part of it, in cases where the consumer has benefited from a discount/promotion campaign (such as free products, gift items, buy 2 get 1 free, and similar), if the minimum amount of the relevant campaign is not reached, the entire amount of the discount/promotion applied and the value of the free product will be deducted from the refundable amount, collected from the consumer. Any gift vouchers, shopping coupons, reward points, or similar obtained by the consumer as a result of the purchase will be completely canceled. If the amount of the used gift voucher, shopping coupon, reward points, or similar is not sufficient, the remaining amount will be collected from the consumer's payment method used in the shopping (including credit card, debit card, etc.).
Points and similar benefits obtained through an organization providing reward points that allow discounts on purchases from our online sales, if there is a contract between the consumer and the SELLER enabling the use of reward points in internet sales, if the consumer has earned a reward point due to this contract as a result of this contract, in cases where the Contract is canceled and terminated due to this Contract for the purchase subject to this Contract, the value or monetary value of the earned reward points, gifts, and similar will be collected back from the consumer.
5- RETURN OF DEFECTIVE PRODUCTS
All the provisions mentioned above will be applied in all cases where product return is involved, except for cases of defective products in which the right of withdrawal is exercised.
6- RESOLUTION OF DISPUTES
The consumer can convey their requests and complaints regarding the product and sale to the SELLER verbally or in writing through the communication channels specified above. If the consumer wishes, they can apply to the Consumer Arbitration Committees in the province and district where they reside or where the SELLER is located within the monetary limits determined and announced by the Ministry of Customs and Trade every year. In cases that exceed the limits, the consumer can apply to the Consumer Courts.
7- OTHER PRE-INFORMATION
All explanations and information in this Preliminary Information Form become valid as of the moment the consumer approves them on our website. Upon your approval on our Internet Site, this information will be sent to your specified email address along with your order confirmation, and you can save and access them at any time. They will be kept in our systems for a maximum of three years in accordance with relevant laws.
